| 中文摘要:目的：分析专利创造性审查的影响因素并深入探讨原因,以期为完善中药复方发明专利的创造性审查标准提供相关参考。 方法：基于中药复方发明专利复审决定数据,运用单因素Logistic回归分析复审决定结果的影响因素。 结果：创造性审查标准受到年度变化的明显影响,在专利复审阶段申请人补充实验数据的撤销驳回决定的概率是未补充实验数据的2.323倍。 结论：我国尚未建立合理、统一、清晰的中药复方发明专利创造性审查标准。采用补充实验数据的方式加以说明其专利申请的技术方案产生了预料不到的技术效果将提高专利复审撤销驳回决定的概率。区别技术特征数量和审查员所引用的对比文件及公知常识情况亦对创造性审查结果产生影响。 |

| Analysis of the influencing factors of patent inventive examination of traditional Chinese medicine composition |

| Abstract:Objective:To analyze the influencing factors of patent inventive examination and explore the reasons, in order to provide relevant references for improving the inventive examination standards of traditional Chinese medicine compound invention patents. Methods:Based on the data of patent reexamination decisions of traditional Chinese medicine composition, the Logistic regression analysis was used to empirically analyze the influencing factors of the reexamination decisions. Results:The inventive examination standard is significantly affected by the annual change. In the patent reexamination stage, the probability of redrawing the rejection decisions by the applicants to supplement experimental data was 2.323 times that of the applicants did not supplement the experimental data. Conclusion:China has not established a reasonable, unified and clear inventive examination standard for Chinese medicine composition patents. Demonstrating that the invention of the application has produced an unexpected technical effect by supplementing the experimental data will increase the probability of redrawing the rejection decision. The number of different technical features, the comparison of documents and common knowledge cited by examiners also influenced the results of inventive examination. |
